Does your insurance have legal cover. You should bill her for your excess and sue her if she does not pay. My policy covers me for that. She needs to learn and why should you be out of pocket.

Not sure, will need to read through the policy and see what the deal is. Pain being at Christmas as every one is on holiday. But thanks for every ones help. Cheers and a Merry Christmas to all.

UPDATE:
Well I cancelled the insurance as the excess was just to much and would probably loose a couple of years no claims as well. So decided to get a quote from a body shop that specialized in plastic panel repairs. Got in touch with a local repair shop that said he sould be able to do it for less than £300 but probably closer to £200 if he only partly sprayed the panel. Second option was to get new panels, so got in touch with my local dealer. They get back in touch with the good news, only £160 for front panel and mudguard. All in the correct colour, great. glad I didn't let the insurance get involved now. Although I'm now £160 out of pocket cause some nutter doesn't know how to use a zebra crossing!!! :x When I was in the dealers he told me that they would be getting a J300 in very soon, so I will be getting a road test on that!!

You say you didn't get the insurance involved but somewhere, on file, is the report. I'd be very careful in future when buying insurance that you declare that incident even if it was not your fault. They specifically ask whether you have had any accidents (not claims) in the last 5 years WHETHER YOU WERE TO BLAME OR NOT. If you don't declare and need to make a future claim you may well find that your insurance is void! For that reason alone, anyone should think very carefully before submitting then withdrawing any insurance claims.

Bollocks. You can claim from the pedestrian as they will have liability cover under an extension of their Home Contents insurance - assuming they have home insurance. And anyway, you can claim from the responsible party whether they have insurance or not - in this case the bint clearly had failed to keep proper control of her child - should have been on a choke chain like all good children and dogs.

Get the quote to here and let her decide how she wants to handle it. ANY prevarication on her part get it into the Small Claims Procedure of the County Court - it only costs a few quid and has the same legal emphasis as two bald-headed men in black leather coats banging on the door asking for money.
